NOTICE OF PROPOSED COMMERCIAL CANNABIS APPEAL PROCEDURES

Notice is hereby given that the Grass Valley Community Development Director is considering adopting regulations governing appeals of decisions of the Commercial Cannabis Selection Committee on Commercial Cannabis Screening Application under authority granted by Grass Valley Municipal Code section 5.60.060. The proposed regulations include:

  • Decisionmaker

    • The Community Development may refer an appeal to the City Council or a hearing officer. If the City appoints a hearing officer, (s)he will provide a recommended written decision to the City Council, which shall be the final decisionmaker.
  • Hearing Procedures, including:
    • Briefing schedules;
    • Right to representation;
    • Optional oral hearings; and
    • Burden of proof and standards of review;
  • Additional Administrative Provisions, including:
    • Finality;
    • Notice of decision;
    • Judicial review; and
    • Exhaustion of administrative remedies.

Written comments provided to public@cityofgrassvalley.com or otherwise received by mail or personal delivery at 125 E Main Street, Grass Valley, CA 95945 by 5:00 p.m. on December 20, 2021 will be considered. Members of the public can also submit public comments via voicemail at (530) 274-4390. After considering all written and oral comments, the Community Development Director shall take whatever final action he deems necessary and appropriate. Adopted Procedures will be posted to the City’s website.
