Section 8.28.150 Enforcement.

    Notwithstanding Section 1.12.010 or anything contained in this code to the contrary, the following procedures shall apply to violations of this chapter:  
    A.    Abatement Orders. The code enforcement officer or other designated city representative may in his or her discretion issue an order requiring immediate abatement of a noise source alleged to be in violation of this chapter;
    B.    When Abated. No complaint or further action shall be taken in the event the cause of the violation has been abated.
    C.    Additional Remedies.
    1.    As an additional remedy, the operation or maintenance of any device, instrument, vehicle or machinery in violation of any provision of this chapter is a public nuisance and may be subject to abatement summarily by a restraining order or injunction issued by a court of competent jurisdiction.
    2.    Additionally, no provision of this chapter shall be construed to impair any common law or statutory cause of action, or legal remedy therefrom, of any person for injury or damage arising from any violation of this chapter or from other law. (Prior code § 13A-16)
