Chapter 5.16 CABLE TELEVISION FRANCHISE
Section 5.16.270 PEG access and contributions.
A. The company shall initially reserve
and make available a minimum of one channel for
public, educational and governmental (PEG) access. Upon request by the city, an additional PEG
access channel will be made available within six months. The company may provide a single
channel for the combined use of several categories of community access users provided that
programming is limited as outlined below and that the city shall have exclusive use of one
channel.
B. All such public access channels
shall be made available free of charge for use by the city
or its designees. The company shall make its best efforts to interconnect the public access
channels with those of other cable television systems operating within Western Nevada County.
The company will work with the city or its designee in its efforts to provide public access
programming. Editorial control of the programming on community access channels shall rest
with the city or its designee. The company shall exercise no editorial control over the public
access channels beyond that necessary to prohibit obscene or unlawful programming.
C. Whenever the specifically designated
access channels are in use for access purposes with
programming during fifty percent of the hours between ten a.m. and ten p.m. during any
consecutive ten weeks running, and when there is a demand for use of an additional PEG access
channel, the company shall, within six months following a request by the city, provide mother
designated channel for this purpose.
D. If an additional channel, beyond
the first two, is designated for community access but
after one year it is not programmed at least twenty-five percent of the hours between ten a.m. and
ten p.m. the company may revert the channel to the company's use upon giving the city six
months' notice if that channel is still not meeting the requirements until such time as the need for
an additional channel is again shown by the original channel meeting the above requirements.
E. The company shall make an initial
contribution of twenty-five thousand dollars for video
equipment to the city for production capabilities. Company shall provide continuing, ongoing
support to PEG access of at least five thousand dollars annually in monetary or nonmonetary
contributions or in-kind contributions, including commercial air time for ongoing PEG access,
which is to be reported to the city by the company in its annual report. In addition, the company,
at its own expense will provide two-way cable access to city hall, a city or other public facility
building, a school, as specified by the city, and the Sierra College site as identified in September,
