Chapter 3.46 REGIONAL TRANSPORTATION FEE
Section 3.46.020 Definitions.
Average P.M. peak hour trips means the average
number of hourly vehicle trips to or from a
designated land use during the p.m. peak hours between 4 p.m. and 6 p.m.
Change of use means any change in the use of
an existing building which results in the
increase of vehicular trips.
Development means any activity which requires
discretionary or ministerial action by the
city resulting in the issuance of grading, building, plumbing, mechanical, or electrical permits, or
certificates of occupancy issued by the city to construct, modify or repair improvements on, or
change the use of, real property. Where development applies to an enlargement of an existing
improvement, or a change of use of an existing improvement or real property which results in
increased vehicle trips, the average p.m. peak hour trips shall be only the additional trips in
excess of those associated with the existing use.
Nevada County Regional Transportation Mitigation Fee
Report, December 7, 2000 means
that current report published by the Nevada County transportation commission, or as
subsequently amended by the entities/jurisdictions of the Nevada County transportation
commission, which is adopted by reference and made a part of this chapter as though fully set
forth herein. A copy of the report shall be made available for public inspection during normal
business hours in the office of the city clerk.
Nevada County transportation commission hereinafter
NCTC , means the legal entity
created and existing pursuant to California Government Code Section 67920 and which will
manage and administer the transportation regional transportation mitigation fee in accordance
with this chapter and the laws of the state of California.
Regional system means those streets, arterials,
and road improvements named in this chapter
as the regional system as set forth in Section 3.46.080 or as may subsequently be amended.
Trip generation rate means the number of average
p.m. peak hour trips generated by a
particular land use. The trip generation rate for each of the following land use categories shall be
the rate published by the Institute of Transportation Engineers (ITE), Trip Generation Manual,
6th Edition, or as revised, as noted in Volumes I and 2
Trip generation rates plots and equations, incorporated
herein by reference, calculated upon
the measurement herein specified. A copy of this manual shall be made available for inspection
by the public during normal business hours in the office of the city clerk. If a developer is
required to prepare a traffic study, the trip generation rate shall be as determined by that traffic
study and approved by the appropriate general purpose government and Nevada County
transportation commission. Trip generation rates shall be calculated based upon the following
measurement:
Production Land Uses
Trip generation rates for single-family, multi-family, rural residential, low density
residential,
and retirement developments shall be based on p.m. peak hour trips per dwelling unit.
Attraction Land Uses
Trip generation for commercial, industrial, employment center, tourist commercial,
community
business district, office professional, public/government, service lodging, school, high density
commercial, park, and church developments shall be calculated by p.m. peak hour trips.
Western Nevada County means the combined boundaries
of the city of Grass Valley, the
city of Nevada City and the unincorporated areas of the western portion of the county of Nevada
which extend east to the boundary line between Range 13E and 14E, all as shown as Nevada
County traffic impact mitigation zones 2, 3A, 3B, 4, 5, 6A, 6B, 7 and 8 on the Nevada County
traffic impact mitigation zone map, attached hereto and incorporated herein by this reference.
