1.0 CALL TO ORDER
Chairman Fouyer called the meeting to order at 7:00 p.m.

2.0 PLEDGE OF ALLEGIANCE
The pledge of allegiance was lead by Andy Cassano.

3.0 ROLL CALL
Commissioner Bateman present x
Commissioner Harrison absent x
Commissioner Ingram present x
Commissioner Swartzendruber present x
Chairman Fouyer present x

Members present were Chairman Jason Fouyer; Commissioners Dawn Bateman, Patti Ingram and Daniel Swartzendruber. Staff present included Planning Director Tom Last and Administrative Clerk Sue Colbert.

4.0 APPROVAL OF AGENDA
Motion by: Commissioner Swartzendruber motioned to approve the agenda.
Second by: Commissioner Ingram
Vote: 4 – 0 for approval. Commissioner Harrison was absent.

5.0 APPROVAL OF MINUTES
Motion by: Commissioner Swartzendruber motioned to approve the action minutes of the October 20, 2009 meeting.
Second by: Commissioner Bateman
Vote: 4 – 0 for approval. Commissioner Harrison was absent.

6.0 PUBLIC COMMENT - There is a time limitation of five minutes per person.

Chairman Foyer opened the public comment at 7:03 p.m.

Andy Cassano, Nevada City Engineering gave thanks to the Planning Commissioners for their service, especially at this busy time of year.

Chairman Foyer closed the public comment at 7:04 p.m.

7.0 CONSENT ITEMS - (roll call vote) All matters listed under the consent calendar are to be considered routine by the Planning Commission and will be enacted by one motion in the form listed. There will be no separate discussion of these items unless, before Planning Commission votes on the motion to adopt, members of the Commission, staff or the public request specific items be removed from the consent calendar for separate action.
There were no consent items.

8.0 PUBLIC MEETINGS / HEARINGS

8.1 General Plan Amendment (09PLN-06) for the 2009-2014 Housing Element Final Draft - Review and recommendation of the City’s Housing Element, a comprehensive housing document that examines the City’s housing needs from the present to the year 2014. The Housing Element is one of the chapters of the City’s 2020 General Plan and is required to be updated by State law. The Housing Element identifies housing needs for current and future residents at all income levels and contains the City’s strategy for meeting those needs. The Draft Housing Element was reviewed by the Planning Commission and City Council, and then submitted to the California Department of Housing and Community Development for the State mandated review. This document incorporates previous comments by the public, Planning Commission, City Council and State Housing and Community Development.

Chairman Fouyer asked for item 8.1 at 7:05 p.m.

Tom Last, Planning Director presented the Final Draft of the 2009 – 2014 Housing Element. He reviewed the key changes from the Draft document that included text additions, clarifications and programs.

Chairman Fouyer opened and closed the public hearing at 7:12 p.m.

Questions of Staff
Chairman Fouyer, Commissioners Ingram and Swartzendruber had questions regarding state requirements, annexations included in the evaluation and low income residents having the ability to purchase housing or to afford rent.

Motion by: Commissioner Ingram motioned to approve General Plan Amendment Application 09PLN-06 for the Final 2009-2014 Housing Element and recommend approval by City Council.
Second by: Commissioner Swartzendruber
Vote: 4 – 0 for approval. Commissioner Harrison was absent.

9.0 NON PUBLIC HEARING ITEMS
There were no non-public hearing items.

10.0 ITEMS REMOVED FROM CONSENT CALENDAR FOR DISCUSSION OR SEPARATE ACTION
There were no items removed for discussion or separate action.

11.0 OTHER BUSINESS


11.1 Review of City Council Items
Tom Last noted the approval of City Council on the Fire Station project. The City is pursuing additional funding for the expansion.

11.3 Future Meetings, Hearings and Study Sessions
No meetings are scheduled for the immediate future. A Study session and site tour for the Planning Commission and public will be scheduled for this spring at Loma Rica Ranch. The Draft EIR will be available in March or April.

12.0 BRIEF ANNOUNCEMENTS / REPORTS BY COMMISSION MEMBERS
There were no announcements or reports by Commission members.

13.0 COMMUNITY DEVELOPMENT DIRECTOR REPORT
Tom Last noted Joe Heckel was not available to convey his Community Development Director report and wished everyone a Merry Christmas.

14.0 ADJOURNMENT: Adjourn to Regular Meeting of Tuesday, January 19, 2010.

Motion by: Commissioner Bateman motioned to adjourn the meeting.
Second by: Commissioner Swartzendruber.
Vote: 4 – 0 for approval. Commissioner Harrison was absent.

Chairman Fouyer adjourned the meeting at 7:22 p.m. to the regular Planning Commission meeting scheduled for 7:00 p.m. on Tuesday, January 19, 2010 in the Council Chambers at City Hall, Grass Valley, California.
